Fireworks in Springville City…

Definition “Firework” means any composition or device manufactured or used for the purpose of producing a visible or audible effect by combustion or detonation but does not include model rocket, toy pistol caps emergency signal flares, snakes or glow worms, party poppers, wire sparklers under 36 inches in length.

Times for sale of fireworks: Fireworks may be sold on or between June 20 and July 25, on or between December 20 and January 2; and 15 days before and on the Chinese New Year.

Time for use of fireworks: Fireworks may be discharged three days prior to, on the day of, and three days following July 4, July 24, January 1, and the Chinese New Year.

Sale or use of unauthorized fireworks: Class “B” misdemeanor. Any person who sells retail or discharges fireworks other than those listed by the State Fire Marshal is guilty of a class B misdemeanor.

General Requirements: All fireworks retail sales locations shall be under the direct supervision of a responsible person who is 18 year of age or older. No person under 14 years of age shall work at any fireworks stand. Fireworks shall no be sold to any person under the age of 16 years, unless accompanied by an adult.

Resolution No. #06-17

A RESOLUTION BANNING THE USE OF FIREWORKS IN PORTIONS OF SPRINGVILLE CITY PURSUANT TO SPRINGVILLE CITY CODE 3-4-21.

WHEREAS, fireworks of a certain nature are permitted in Springville City for the enjoyment of the citizens;

WHEREAS, due to the dry year and dangerous nature of fireworks, it is prudent to restrict the use of fireworks within the boundaries of Springville City; and

WHEREAS, to protect the citizens of Springville and their property, the Springville City Council desires to restrict the use of fireworks to protect the public safety

NOW, THEREFORE, be it resolved by the City Council of Springville City that the use of fireworks within the boundaries of Springville City shall not be allowed in the area set forth on the attached map and description. The use of fireworks within the restricted areas shall be considered a violation of Chapter 4 of Title 3 of the Springville City Code. This ban shall remain in effect from the effective date of this resolution until July 30, 2006.

Passed by the City Council of Springville City this 6th day of June, 2006. This resolution becomes effective on the day following the date of adoption.
